The BiH CEC pronounced pecuniary fines

Sarajevo, 25.09.2018 – The BiH Central Election Commission has passed today two decisions pronouncing pecuniary fines to two political subjects and two candidates certified to participate in the General Elections scheduled for October 7, 2018.

                                                                       

It has been determined that the political subject DF-GS, Željko Komšić: BiH WINS (Democratic Front and Citizens’ Alliance), is responsible for Adžem Dževad, candidate of this political subject for the House of Representatives of the FBiH Parliament, using on his Facebook profile language which could provoke or incite someone to violence or spread hatred thus violating rules of conduct in the election campaign set forth by Article 7.3, paragraph (1), point 7) of the BiH Election Law. Therefore, the following sanction is pronounced in line with Article 6.7, point 1 and by application of Article 19.9, paragraph (1), point j) of the BiH Election Law

 

- pecuniary fine in the amount of BAM 1.000 (one thousand Convertible Marks) to be jointly paid by the members of this coalition Democratic Front and Citizens’ Alliance, in the amount of BAM 500 each.

 

It has been determined that Adžem Dževad, candidate of the political subject DF-GS, Željko Komšić: BiH WINS for the House of Representatives of the FBiH Parliament has on his Facebook profile, on 10.09.2018, used language which could provoke or incite someone to violence or spread hatred thus violating rules of conduct in the election campaign set forth by Article 7.3, paragraph (1), point 7) of the BiH Election Law. Therefore, the following sanction is pronounced in line with Article 6.7, paragraph (1), point 1 and Article 19.9, paragraph (4) of the BiH Election Law

 

- pecuniary fine in the amount of BAM 3.000 (three thousand Convertible Marks).

 

It has been determined that the political subject Alliance for victory (Serb Democratic Party and Party of Democratic Progress) is responsible for Vukota Govedarica, candidate of the political subject for the President of RS using on 15.09.2018 language which could provoke or incite someone to violence or spread hatred thus violating rules of conduct in the election campaign set forth by Article 7.3, paragraph (1), point 7) of the BiH Election Law. Therefore, the following sanction is pronounced in line with Article 6.7, point 1 and by application of Article 19.9, paragraph (1), point j) of the BiH Election Law

 

- pecuniary fine in the amount of BAM 7.000 (seven thousand Convertible Marks) to be jointly paid by the members of this coalition Serb Democratic Party and Party of Democratic Progress in the amount of BAM 3.500 each

 

It has been determined that Vukota Govedarica, candidate of the political subject for the President of RS, had on 15.09.2018 used language which could provoke or incite someone to violence or spread hatred thus violating rules of conduct in the election campaign set forth by Article 7.3, paragraph (1), point 7) of the BiH Election Law. Therefore, the following sanction is pronounced in line with Article 6.7, paragraph (1), point 1 and Article 19.9, paragraph (4) of the BiH Election Law

 

- pecuniary fine in the amount of BAM 5.000 (five thousand Convertible Marks).

 

The decisions are not final and can be appealed before the Appellate Division of the Court of BiH within two days following receipt of the decision.
